Arbitration shall be conducted in the State of New Jersey in accordance with the rules of a recognized arbitration provider, such as the American Arbitration Association, then in effect. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

You and the Willowwood Foundation agree that arbitration shall be conducted on an individual basis only, and not as part of a class, collective, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration related to any dispute covered by this clause.
This arbitration provision does not prevent either party from seeking temporary or injunctive relief in a court of law to protect its rights pending the outcome of arbitration.

Except as otherwise required by the rules of the arbitration provider, the prevailing party in any arbitration shall be entitled to recover reasonable costs and fees incurred in connection with the arbitration, including filing fees, administrative fees, and attorney’s fees. The arbitrator shall determine which party is the prevailing party. If the arbitrator finds that a party’s claims or defenses are frivolous or without merit, that party may be required to pay all costs and fees associated with the arbitration, including the prevailing party’s reasonable attorney’s fees.

13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict-of-law principles.

The Foundation may update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Website constitutes acceptance of the revised Terms.
